The purchase or sale of a home is one of the most important decisions you will ever make. Thomas A. Moseley, Chartered will assist you in making a smart real estate decision. Since the purchase contract is a blueprint for closing your home- it dictates in black and white how the rest of the transaction will unfold-never sign a contract without us reviewing it. At the very least, you should write in a contingency clause stating the contract is valid only with your attorney’s approval. There is really no such thing as a “standard and customary” contract.
Our focus in any real estate transaction is to minimize the worry and fear usually associated with such transactions and to assure a problem free closing. We can handle all aspects of your real estate transaction from contract to closing, including:
- Reviewing the contract, ensuring all provisions and contingencies are in your best interests
- In proper legal language, adding any contingencies needed to protect your interests
- Informing you of your legal rights and obligations
- Obtaining a title search, evaluating the status of the title, and requiring appropriate legal remedies to clear any defects
- Checking for unrecorded municipal liens, including sewer and special assessment liens
- Advising you on what the title insurance policy does not protect against, emphasizing marketability of title
- Preparing or reviewing the closing statement and other closing documents
- Interpreting and counseling you regarding all legal documents related to the title and the transaction, including deeds, mortgages, and closing statements
- Advising you on how you should take title to the home, and how this affects your estate
- Preparing a bill of sale to cover any personal property such as curtains and appliances that remain in the house
- Informing you about the income, estate, and gift tax consequences to your estate
